Set out below are the Terms and Conditions of Turning Point Travel Ltd (hereinafter referred to as "TPTL"):

1. Booking Requirements
Tour bookings should be made by online submission, and should be made at least 3 months prior to the desired tour date.
Booking requests will be acknowledged by email.

Standard for all tours: all categories of accommodation will be provided on a twin sharing basis. A single occupant surcharge willbe imposed on clients who do not have another tour participant to share with or who simply prefer individual privacy. This surcharge will be in addition to the quoted tour price. TPTL reserves the right to charge compensation in case of changes relating to a booked tour.

In the countries and regions where Turning Point Travel tours are conducted (Mongolia, Nepal, Bhutan, Tibet and the Indian Himalayas), bookings of airlines and hotels/resorts/lodges/tea houses/ger camps/etc require pre-payment well in advance to ensure that tours run according to schedule. Hence the need for early booking confirmations, timely progressive payments, and the need for strict Payment and Refund policies.

2. Payment Schedule
Tour bookings will be confirmed upon payment of a 10% booking fee. This payment is required in US dollars and should be made within 14 days of the booking date ... at least 3 months prior to the desired tour date.

Balance payments will be required according to the following schedule:
- 50% due at least 2 months (60 days) prior to the scheduled tour date
- 40% due at least 1 month (30 days) prior to the scheduled tour date

Payment can be made online via PayPAL (a secure online payment facility) with any valid major credit card, or by bank wire transfer (TT details given upon request / bank charges on client's account).

3. Tour Cancellation and Refund Policy
Written notification (via email) is required to cancel a booked tour.

If a written tour cancellation is received, assuming that progressive payments have been made in accordance with the above-stated Payment Schedule, the following refund policy will apply:

* Within 2 weeks of booking confirmation – full refund of 10% booking fee
* Booking fee will not be refunded beyond 2 weeks (14 days) after receipt of booking confirmation
* Between 45 and 60 days from the scheduled tour date – 60% refund on payments received
* Between 30 and 45 days from the scheduled tour date – 40% refund on payments received
* Less than 30 days from the scheduled tour date – no refund will be given

4. Pricing / Basis of Rates / Currency Fluctuation
Tour prices are quoted in US dollars and include planning, handling and operational charges, and are based on current rates of exchange, tariffs and taxes. TPTL reserves the right to revise the price of any tour posted on the company website in the event of various external factors that are beyond TPTL's control: for instance, changes in exchange rates/currency fluctuations, increased land and/or air transport costs, government action, etc. TPTL will do everything possible to maintain the listed prices. If it is necessary to levy a surcharge, TPTL reserves the right to do so, and notification will be given at the time of final invoicing.

5. Changes in Itinerary / Drop out from Journey
Client requests for tour itinerary changes should be made in advance. However, changes to a tour itinerary may be required en route under certain circumstances (for instance, bad weather, etc) at the discretion of the tour leader.
No refund will be made to Clients who wish to drop out from a tour regardless of the reason and regardless of whatever portions of the itinerary remain unused.

6. Statement of Limited Liability
TPTL shall not be responsible for any delays and en route alterations in the program, expenses incurred directly or indirectly due to natural hazards, flight cancellations, accidents, breakdown of transport, weather, sickness, landslides, road closures, blockades due to political unrest or any such incidents. TPTL shall not be responsible for any loss, injury or damage to person, property or otherwise in connection with any accommodation, transportation or other services resulting directly or indirectly from any act of nature, fire, accident, strikes, thefts, or any other causes beyond TPTL's control.

TPTL acts as agent for transport companies, hotels and contractors and shall not be held liable for injury, damage, loss, delay or irregularity that may occur … including, but not limited to, any defect in a vehicle or any other form of conveyance. TPTL shall not be responsible for acts or defaults of any company or person engaged in conveying a traveler, acts of God, detention, delays or expenses arising from quarantine, strike, theft, civil disturbance, government restriction or regulation, accident by aircraft, boat, bicycle, motor vehicle or any other form of transport, or in any hotel, guest house, or other form of accommodation.

The traveler understands that during the course of the trip, certain risks may occur including, but not limited to, the forces of nature and the hazard of accident or illness in remote places without medical facilities. The traveler agrees to assume all risk associated with the journey and must agree that TPTL, it's employees, agents and any member of the group, shall not be held liable for personal injury, death, illness or delay of the traveler or any subsequent loss or damage to the traveler, including loss of, or damage to, property of the traveler, during the course of the trip, regardless of howsoever caused, whether occurring in the country or elsewhere. TPTL will not accept responsibility or liability for any traveler who contravenes any laws or regulations of any country visited. Should a traveler be detained as a result of infringement of any law or regulation of any country, he or she may be excluded from the tour by the group leader without any right of refund or any other claim. No employee or agent of TPTL has the authority to vary these conditions.

7. Client Responsibilities
Clients are responsible for obtaining a relevant travel visa (please see our FAQ section for visa information). Passports should be valid for at least 6 months beyond the intended return date. Clients are responsible for providing TPTL with correct, complete and accurate information regarding personal details, including any health problems and/or physical disabilities. Clients must tell us if they have an existing medical condition or disability that might affect their holiday or other group members' enjoyment of it, before booking a tour. If, in our reasonable opinion, the selected tour is not suitable for a client based on his/her medical condition or disability, we reserve the right to refuse the client's booking. Clients are required to provide proof of travel and health insurance for any tour booked. TPTL requires all tour participants to have travel and health insurance policies covering medical and accident risks; repatriation; tour cancellation; damage to, loss or theft of baggage. Evacuation insurance (helicopter rescue if required) is also strongly recommended. If tour participants are unable to find their own evacuation insurance coverage, TPTL can arrange evacuation insurance through International SOS at additional cost. Clients are responsible for bringing clothing and equipment appropriate for the selected tour.

8. Tour Leader Authority
By signing our booking form, clients acknowledge and agree to abide by the decisions of the tour leader. Moreover, clients acknowledge and agree that the tour leader has full authority over the tour itinerary, including en route changes to the schedule (ie location of overnight lodging locations, amount of time spent at each destination, etc). In the event clients have a concern about their tour, they should notify the tour leader regarding such a concern. The tour leader may remove clients from the tour for any reason that may negatively effect, or cause interruption to, a group's experience, including behavior that may cause harm or danger to another passenger or third party. If the leader feels that a client's general wellbeing will be put at risk by continuing with the tour, the client may be asked to leave the tour without the right to any refund for unused services.

9. Flight Delays
There always exists the possibility of flight delays or postponements due to unanticipated schedule changes, mechanical problems or harsh weather conditions. Clients are advised to reserve extra days to allow for possible delays in order to avoid any frustrating consequences that could arise from such delays. In the case of a flight delay prior to or following a tour, clients will be required to cover the cost of food, accommodation and personal expenses during the period of the delay.

10. Health Regulations
It is the client's responsibility to become informed about health regulations and required immunization protection. Clients must provide accurate health and medical information to TPTL using the Individual Medical Profile form that can be downloaded from the company website.

11. Cancellation of Tour by TPTL
If TPTL is forced to cancel a particular tour due to a shortfall in tour participants, or unforeseen circumstances such as war, natural disasters, conflict, unfavorable climate, etc., TPTL will be pleased to refer clients to an alternative tour. If clients are not satisfied with the proposed alternative, then all money paid by the client to TPTL will be refunded. Any other expenses incurred by clients as a result of the booking are entirely the client's responsibility.
